Throughout this site, the terms “Bahía Residences”, “we”, “us”, and “our” refer to Bahía Residences and its operating entity, Grupo Itúa, S.A. de C.V.
By accessing, browsing, or using our website, submitting an inquiry, applying to any of our programs, purchasing a gift card, or engaging with our services in any way, you agree to be bound by these Terms & Conditions, along with our Privacy Policy and any additional policies referenced herein.
If you do not agree with these Terms, you should refrain from using our website and services.
2. Scope of Services
Bahía Residences operates as a luxury travel brand offering:
Curated vacation rentals and private residences
Concierge and travel-related services
Gift cards
Travel Partners and Affiliate Programs
Informational content and destination inspiration
Bahía Residences does not operate as a hotel chain and does not provide standardized accommodation services. Each property is independently owned and governed by its own specific rental terms.
3. Booking & Stay Terms (Property-Specific)
All confirmed stays are governed by a separate and customized Vacation Rental Agreement specific to each property.
These individual agreements define, among other things:
Check-in and check-out times
Minimum and maximum occupancy
House rules and usage restrictions
Cancellation and payment policies
Security deposits (if applicable)
Liability limitations
In the event of any inconsistency between this website and a property-specific agreement, the property-specific agreement shall prevail.
Bahía Residences facilitates the booking process but does not replace or override the contractual terms of each individual property.
4. Inquiries & Requests
Submitting an inquiry through our website does not constitute a reservation or guarantee availability.
All inquiries are subject to review, availability, pricing confirmation, and acceptance by Bahía Residences and/or the property owner.
We reserve the right to decline any inquiry at our discretion.
5. Gift Cards
Gift cards issued by Bahía Residences:
Are non-refundable
Have a validity period of 12 months from the date of issue, unless otherwise stated
Must be used in accordance with availability and applicable property terms
Are not redeemable for cash
Are subject to any additional conditions stated at the time of purchase
Unused value after expiration will be forfeited.
Bahía Residences is not responsible for lost, stolen, or misused gift cards.
6. Travel Partners Program
Participation in the Bahía Residences Travel Partners Program is subject to approval.
Approved Travel Partners:
Receive a unique identification number
Must include this identification number when submitting booking enquiries
Are responsible for ensuring accurate client information
Bahía Residences reserves the right to modify, suspend, or terminate participation in the program at any time if misuse, misrepresentation, or misalignment with brand standards is identified.
7. Affiliate Program
Participation in the Affiliate Program is subject to acceptance and ongoing compliance.
Affiliates:
Earn commissions only on qualifying bookings completed through approved tracking methods
Are not authorized to make binding offers, guarantees, or representations on behalf of Bahía Residences
Must comply with ethical marketing practices and applicable laws
Bahía Residences reserves the right to adjust commission structures or terminate affiliate relationships at its discretion.
8. Payments & Pricing
All prices displayed or quoted are subject to change without prior notice.
Payments may be processed through secure third-party payment providers. Bahía Residences does not store full credit card details.
Currency conversions, bank fees, international charges, or payment authorization issues are the sole responsibility of the user.
9. User Eligibility, Authority & Use of Payment Methods
By using this website and its services, you represent and warrant that:
You are of legal age in your country or jurisdiction of residence, or that you have the legal capacity and authorization to use this website and enter into binding agreements
Any information you provide, including personal details and payment information, is accurate and submitted with proper authorization
Bahía Residences does not have the ability to verify the identity, age, or legal authority of users, nor the ownership or authorization of payment methods used.
Any use of another person’s payment method, identity, or personal information without proper authorization is strictly the responsibility of the user and does not create liability for Bahía Residences or Grupo Itúa, S.A. de C.V.
10. Intellectual Property
All content on this website, including text, images, logos, branding, and design elements, is the property of Bahía Residences or its licensors.
Unauthorized reproduction, distribution, modification, or commercial use of any content is strictly prohibited.
